Common Causes of Wrongful Death in Las Vegas

Not all tragic deaths are wrongful deaths. Under Nevada law and the laws of other states, a wrongful death occurs when a wrongful act or neglect leads to one’s death. Family members and the decedent’s representative can bring two separate actions: damages for family members’ losses and damages the deceased suffered up to the time of death.

Car, motorcycle, and truck accidents are among the leading causes of wrongful death. Speeding, DUI, distracted driving, and reckless behavior often result in fatal crashes on busy roads like I‑15 and the Las Vegas Strip.

Las Vegas sees some of the highest pedestrian fatality rates in the country. Drivers who speed, run red lights, or fail to yield at crosswalks on the Strip and busy surface streets can be held liable when a pedestrian is killed.

Surgical errors, misdiagnosis, medication mistakes, and delayed treatment can turn fatal. Fatal malpractice claims follow a different filing deadline than other wrongful death cases, so acting quickly matters.

Fatal workplace incidents, especially in construction, often result from unsafe conditions, equipment failures, or inadequate safety measures. Families may have claims beyond workers' compensation when a third party caused the death.

When a product fails unexpectedly and causes death, manufacturers, distributors, and retailers can be held liable. These cases require fast investigation to preserve the product and prove the defect.

Who Can File a Wrongful Death Lawsuit in Nevada?

Under NRS 41.085, two parties have legal standing to file after a death in Nevada:

The heirs of the deceased, which generally include a surviving spouse or domestic partner, children, and in some cases parents. Heirs file for their own losses, such as grief, loss of companionship, and lost financial support.
The personal representative of the estate, who files on behalf of the deceased to recover losses the deceased suffered before death.

A person who wrongfully caused the death cannot recover as an heir. If no representative is named in a will, the court appoints one.

Wrongful Death Claim vs. Survival Action

Nevada law allows two distinct claims after a death, and they are often filed together. A wrongful death claim compensates surviving family members for their own losses, including loss of companionship, emotional suffering, and lost financial support. A survival action is brought by the estate to recover what the deceased suffered between injury and death, such as medical bills and their own pain and suffering. Pursuing both maximizes the family's total recovery.

What Damages Can Families Recover for Wrongful Death?

Nevada's wrongful death statute allows two categories of damages, split between the heirs and the estate.

Heirs may recover for:

Grief, sorrow, and lost companionship
The financial support the deceased would have provided
Loss of the household services they handled
Loss of consortium

The estate recovers separately: funeral and burial costs, any medical bills the deceased racked up before death, the pain and suffering they endured, and punitive damages when the negligence was gross.

How Long Do You Have to File a Wrongful Death Claim in Nevada?

In Nevada, you have two years from the date of death to file a wrongful death lawsuit, under NRS 11.190. Missing this deadline usually bars the claim permanently. Because evidence disappears and memories fade, contacting a lawyer early lets the family preserve what the case depends on.

The Medical Malpractice Exception

When a death results from medical malpractice, a different deadline applies. The claim must be filed within three years of the injury or two years from when the injury was discovered, whichever comes first. That window is shorter than it sounds, and missing it ends the claim. Families who suspect malpractice killed someone should not wait to get it reviewed.

How a Las Vegas Wrongful Death Lawyer Proves Fault
